Advise4Life: members of the VOF Advise4Life
customer: the person who comes to Advise4Life with a question
contractor: the person within the network of Advise4Life who receives an order from Advise4Life
The personal data that Advise4life stores only includes the contact details and the question of customers. This data is obtained by the customer himself. This data is stored in the mailbox of info@advise4life.coml. Only the partners of the VOF Advise4Life can access this mailbox. This data will be deleted two months after completion of the assignment.
If an order is placed within the network of Advise4Life and the customer agrees, the customer data will be shared with the contractor in order to be able to provide the service. The responsibility for the personal data then lies with the contractor.
The data of a contractor is provided by the contractor itself. And it only concerns contact details and optional text about the services of the contractor. We will keep this data until the contractor indicates that it wishes to leave the network. Then the data will be deleted.
Invoices are kept in an excel/accounting file. This file is stored on an external hard drive, which only the controller uses and can access.
In the unlikely event that data is leaked due to theft of a hard disk or another unforeseen event, the data leak will be indicated.
ALGEMENE VOORWAARDEN ADVISE4LIFE
Definitions
Advise4life - represented by Marjan Heitman. If she speaks on behalf of Advise4life, she will use Advise4life as her name.
Customer - person who approaches Advise4life with a question/request for advice.
Contractor - company or person who is offered an assignment via Advise4life.
Article 1 Applicability
1.1 These terms and conditions apply to all agreements between customers and between contractors, whereby Advise4life can then act both as a contractor or as a client with regard to the assignment, offer and advice in the broadest sense of the word.
1.2 Deviations from this agreement are only binding if confirmed in writing by Advise4life.
1.3 Acceptance of advice or an offer constitutes acceptance of these Terms and Conditions. Advise4life reserves the right to change the Terms and Conditions at any time.

Article 2 Offer & Formation of the assignment
2.1.1 Advise4life & customer
Advise4life provides a quote for future services without obligation and free of charge. Prices depend on the type of service (advice, mentoring, coaching and mediation) and/or the contractor to which the customer may be referred. It is up to the customer to accept this. An offer is made in writing. If accepted - in writing or verbally - the agreement is binding.
2.1.2 If it concerns a one-off advice with a substantive answer to the question, Advise4life will indicate whether they have their own advice. If so, this will be communicated and the customer can agree by verbal or written commitment. This is binding. There will be an advisory fee between 25 and 75 euros depending on the time spent. This will be communicated in advance. If during the assignment for advice it appears that there is more to it (more than 1 hour) and therefore a higher advice fee is necessary, this will be communicated in good time and discussed with the customer.
2.2 Advise4life & contractor
Advise4life discusses beforehand with various contractors and communicates its working method. A contractor can join the network after a click conversation to which all members of Advise4Life agree to join the network. When accepting an assignment, a contractor agrees to the general terms and conditions. If Advise4life has an assignment that it will not carry out itself as a contractor, it will be submitted to a suitable contractor within the network. The contractor makes an offer. Advise4life charges the contractor a fee of 10% of the offer. The 10% fee, for the time being with a maximum of 1,000 euros, is binding as soon as the customer has accepted the offer with the contractor in writing or orally.
Article 3 Execution, Cancellation and Change of assignment
3.1 Advise4life & customer
3.1.1 The customer is given the option of accepting or not accepting the advice or offer. If the customer accepts this, the agreement is binding and cannot be canceled. In the event of a clear case of force majeure, Advise4Life will enter into a conversation with the customer. If the customer is referred to a contractor, the cancellation conditions of a contractor are leading for the customer. In the event of an option to cancel, the terms and conditions of the relevant service provider apply.
3.1.2 If the assignment is canceled or terminated prematurely by the contractor, Advise4life will do its utmost to offer a new suitable contractor. Without Advise4Life being able to give a guarantee that they will be able to identify another suitable contractor within the foreseeable future.
3.2 Advise4life & contractor
3.2.1 The contractor will perform the assignment to the best of its knowledge and ability and in accordance with the requirements of good workmanship and not give it to third parties.
3.2.2 The contractor does not have a contract with Advise4life, but does have a verbal agreement for future assignments and will therefore give priority if Advise4life offers an assignment. If an order is accepted orally or in writing, it is binding. In case of cancellation of the assignment, a 5% fee of the assignment is owed to Advise4Life. An exception is in case of force majeure. Force majeure is understood to mean, in addition to what is understood in this regard in the law and jurisprudence, all external causes, foreseen or unforeseen, on which no influence can be exercised, but as a result of which it is not possible to fulfill the obligations.
3.2.3 The cancellation conditions of the contractor are leading towards the customer and the fee owed to Advise4life is calculated proportionally at 10%. Unless otherwise agreed. If the client has no cancellation conditions, agreements will be made in advance.
3.2.4 If an order changes in the meantime, the contractor will inform Advise4life of this, so that the invoice (10% fee) can be adjusted.
3.2.5 If the contractor itself terminates the assignment prematurely, the 10% fee paid to Advise4Life will in principle not be refunded to the contractor. Unless otherwise agreed in advance.
3.3 Advise4life has the right to cancel or change the advice or the offer without giving any reason. This must be communicated to the customer or contractor in a timely manner.
Article 4 - Payment
4.1 Advise4life & customer
Payment of a one-off advice given by Advise4Life takes place after giving or receiving the advice by means of an invoice. This must be paid by the customer within 14 days.
4.2 Advise4life & contractor
The payment of the fee of 10% from the contractor to Advise4Life takes place after the first customer/contractor meeting.
4.3 Collection costs
If an invoice is not paid on time, the customer or contractor will receive a payment reminder or will be personally addressed. If the customer or contractor fails to pay an invoice on time, the customer or contractor is legally in default. In the event of default due to late payment of the invoice, statutory interest is due. If it is still not paid after 10 days, an additional € 5.00 will be charged. For every 10 days, € 5.00 is added.
4.4 Objections to the amount of an invoice do not suspend the payment obligation. The Client who cannot invoke Section 6.5.3 (Articles 231 to 247, Book 6 of the Dutch Civil Code) is also not entitled to suspend payment of an invoice for any other reason.
Article 5 - Liability
5.1 Advise4life makes every effort to carry out the assignments given to the best of its knowledge and ability.
5.2. Advise4life and/or Marjan Heitman, Luiz Veloso, Shelly Linssen cannot be held liable for assignments carried out by third parties. The responsibility for the assignment remains with the contractor. (also in case of cancellation, change and force majeure). The terms and conditions of the contractor apply here.
5.3 Advise4life is not liable for damage, of whatever nature, caused by Advise4life acting on the basis of incorrect and/or incomplete information provided by or on behalf of the customer or contractor.
5.4 Advise4life is not liable for loss, theft and/or damage to personal property or injuries incurred as a result of and/or during services provided.
5.5 Advise4Life is liable for shortcomings in the execution of the assignment, insofar as these are the result of failure to observe the care, expertise and craftsmanship that may be relied upon in the context of the assignment in question. The liability for damage caused by the shortcomings is limited to the amount of the fee that Advise4life receives for its work in the context of the assignment. Or at most once the invoice value of the assignment, at least up to that part of the assignment to which the liability relates.
5.6 Complaints about the service provided directly by Advise4Life (and not via a contractor who uses its own complaints procedure) will at all times be taken seriously and discussed with a customer/principal.
Article 6 - Force majeure
6.1 Advise4life is not obliged to fulfill any obligation if it is prevented from doing so as a result of a circumstance that is not due to fault, and is not for its account under the law, a legal act or generally accepted standards.
6.2 In these general terms and conditions, force majeure is understood to mean, in addition to what is understood in the law and jurisprudence, all external causes, foreseen or unforeseen, over which Advise4life has no influence, but as a result of which Advise4life is unable to fulfill its obligations. come.
6.3 Advise4life can suspend the obligations under the agreement during the period that the force majeure continues.
Article 7 - Disputes
7.1 Dutch law applies to every agreement between Advise4life and a customer or contractor. Disputes arising from agreements to which these terms and conditions apply will be submitted to the competent court in The Hague, unless the law prescribes otherwise. Nevertheless, Advise4life has the right to submit the dispute to the competent court according to the law.
7.2 Parties will only appeal to the courts after they have made every effort to settle a dispute in mutual consultation.
